Terms of Service

1. Agreement and Operator

These Terms of Service are an agreement between you and Velko, the operator of the Velko app. By accessing or using Velko, you accept these Terms. If you do not agree, do not use the app. Our Privacy Policy explains how personal information is handled.

2. Eligibility

You must be at least 13 years old to use Velko. If you are under the age of legal majority where you live, you must have a parent or legal guardian's consent. You are responsible for complying with laws that apply to your use.

3. The Service and License

Velko helps cross-stitch makers record progress against 10-by-10 chart blocks, floss color codes, stitch counts, time spent, and session notes. It organizes these entries into project tools, rule-based weekly progress reports, and optional paid memorial exports. Velko does not provide artificial-intelligence generation, analysis, or chat features.

Subject to these Terms, Velko grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on Apple-branded devices you own or control, as permitted by the Apple Media Services Usage Rules. Family Sharing and volume purchasing may permit access by associated accounts where Apple allows it. The app is licensed, not sold; all rights not expressly granted are reserved.

4. Access and Profile

You may use Velko’s core stitching features after completing onboarding and setting a display nickname and optional avatar. Velko does not require email registration or a password account to use those features. Keep your device secure. If you suspect unauthorized purchases or misuse, contact us through the App Store product page for Velko.

You can review and edit your project information in the app. To remove app data, use the in-app delete control or uninstall Velko. Deletion cannot restore consumed coins or previously generated paid exports that you already used or discarded.

5. Acceptable Use

You must not:

• Copy, reverse engineer, decompile, modify, or try to extract the app's source code, except where applicable law expressly permits it.
• Resell, sublicense, or commercially exploit the app, its access, or its outputs without written permission.
• Attack, probe, overload, bypass security, or interfere with the app or related services.
• Upload or use unlawful, infringing, malicious, or misleading material.
• Harass others, impersonate another person, or misrepresent your affiliation with anyone.
• Use the app in a way that violates applicable law or third-party rights.

6. Your Content

You retain any rights you have in the photos, chart references, stitch counts, floss details, notes, and other material you enter. You grant Velko a limited, non-exclusive license to process and display that material only as needed to operate the features you use on your device and to handle support requests you submit. You confirm that you have the rights needed to submit it, including any rights in chart images or patterns created by others.

7. Reports and Exports

Weekly progress reports are calculated from your own records using deterministic rules. They are for personal reference only and are not professional advice. Paid memorial cards, posters, archives, backups, and similar exports are digital goods delivered in the app after a successful coin purchase or free-trial unlock where offered. Delivery failure for a paid export is handled according to the in-app purchase rules and Apple’s policies.

8. Purchases

Coins are one-time consumable in-app purchases and have no cash value outside Velko. The app shows the applicable purchase price, coin amount, and what you unlock before you buy or spend coins. Consumed coins and unlocked exports are generally not restored by “Restore Purchases,” which only helps finish interrupted Apple transactions.

This app does not offer any subscription, recurring payment, or auto-renewing service. All purchases are one-time consumable in-app purchases.

Apple processes App Store payments and handles refund requests under its App Store policies. Any statutory refund rights remain available to you.

9. Intellectual Property and Copyright Complaints

Velko and its software, design, text, and branding belong to Velko or its licensors and are protected by applicable intellectual-property laws. Your rights in your own content are described above.

If you believe material in Velko infringes your copyright, submit a notice through the App Store product page for Velko with your name and contact details, identification of the copyrighted work, the location of the material at issue, a good-faith statement that the use is unauthorized, a statement that your notice is accurate and you are authorized to act, and your physical or electronic signature. We may remove material while reviewing a complaint.

10. Third-Party Services

Velko uses Apple for distribution and in-app purchases. Those services operate under their own terms and policies. You must comply with applicable third-party terms when using the app. Velko is not responsible for a third party's independent service, content, or availability, except where applicable law requires otherwise.

11. Termination

You may stop using Velko and clear app data at any time. We may suspend or terminate access if you materially breach these Terms, misuse the service, or create a security or legal risk. Where practical, we will notify you through the App Store product page and give you a chance to address the issue. On termination, your license ends. Provisions concerning your content rights, purchases already made, intellectual property, disclaimers, liability, indemnification, disputes, and general legal terms survive to the extent needed to give them effect.

12. Disclaimers

To the extent permitted by applicable law, Velko is provided "AS IS" and "AS AVAILABLE," without warranties of uninterrupted availability, accuracy, or fitness for a particular purpose. We do not guarantee that progress reports or exports will match every chart publisher’s conventions. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

13. Limitation of Liability

To the extent permitted by applicable law, Velko is not liable for indirect, incidental, special, consequential, or punitive damages, including lost data, profits, or opportunity. Velko's total liability for all claims arising from the app or these Terms is limited to the greater of the amount you paid to Velko through the app in the 12 months before the event giving rise to the claim or US $50. These limits do not apply where prohibited by law and do not reduce mandatory consumer protections.

14. Indemnification

To the extent permitted by law, you will defend and indemnify Velko against third-party claims, losses, and reasonable costs arising from your breach of these Terms, your unlawful use of the app, or content you submit that infringes another person's rights. This obligation does not apply to the extent a claim results from Velko's own conduct.

15. Governing Law and Disputes

These Terms are governed by the law applicable to the dispute under the relevant conflict-of-laws rules. Any court proceeding must be brought before a court that has jurisdiction over the parties and the dispute under that law. Before filing a claim, please contact us through the App Store product page for Velko; we will try in good faith to resolve it within 30 days. This informal step does not prevent either party from seeking urgent relief or exercising rights that cannot be delayed. Nothing here limits mandatory consumer protections available where you live.

16. Apple App Store Terms

The following terms apply when you obtain Velko through Apple's App Store:

• These Terms are between you and Velko only, not Apple. Velko is solely responsible for the app and its content.
• Your license is limited to use on Apple-branded products you own or control as permitted by Apple's Usage Rules, including permitted Family Sharing or volume purchasing.
• Velko is responsible for app maintenance and support; Apple has no obligation to provide either.
• To the extent any applicable warranty is not effectively disclaimed, Velko is responsible for it. If the app fails to conform to such a warranty, you may notify Apple and Apple may refund the purchase price for the app. To the maximum extent permitted by law, Apple has no other warranty obligation; Velko is responsible for other related claims and costs.
• Velko, not Apple, handles claims about product liability, legal or regulatory compliance, consumer protection, privacy, and your possession or use of the app.
• Velko, not Apple, is responsible for investigating, defending, settling, and discharging third-party intellectual-property infringement claims concerning the app.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms, including those of your network or wireless data provider, when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. On your acceptance, they have the right to enforce these Terms against you as third-party beneficiaries.

17. Changes to These Terms

We may update these Terms and will revise the "Last updated" date above. For material changes, we will provide notice in the app before they take effect. Continuing to use Velko after the effective date of an update means you accept the revised Terms; if you do not accept them, stop using the app and clear your app data.

18. General

If any provision is unenforceable, the remaining provisions remain effective. These Terms and the Privacy Policy form the complete agreement concerning your use of Velko, except for terms that applicable law requires or that are presented with a specific feature. Failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without our consent; Velko may transfer these Terms as part of a lawful business transfer, subject to your mandatory rights.
